Overview of legislation in Seychelles 

Acts of Seychelles are passed by the National Assembly and assented to by the President.  An Act is the equivalent of a “statute” or a piece of “primary legislation” in other countries.

Statutory Instruments (SI) of Seychelles are promulgated under a particular Act by a person who has delegated authority under that Act: for example, a Minister, or the Chief Justice.  An SI is the equivalent of a “regulation”, “rule”, “order”, or piece of “secondary legislation” in other countries.

Legislation does not take effect until it is published in the Official Gazette.

Legislation published on SeyLII

The legislation collection on SeyLII has four main pages:

1. eGrey Book of Seychelles: This is a specially developed online resource containing 80 of the most commonly cited Acts in Seychelles and their associated statutory instruments (SI).    You can browse and search online or download an Act in PDF or ePub.  The index to the eGrey Book is here.

2. Laws of Seychelles / Consolidated Acts:  This section contains all the Acts that have been allocated a chapter (Cap) number in the official Laws of Seychelles.  For example, the Constitution of the Third Republic is Cap 42.  Most of the Acts in this section were enacted before 1996.   Statutory instruments (SI) enacted under these Acts are reproduced at the end of the relevant Act. 3. Numbered Acts: This section contains all the Acts that do not yet have a Cap number and are therefore referred to by the order in which they were enacted.  For example, the Energy Act, 2012 is Act 11 of 2012.   Statutory instruments (SI) enacted under these Acts are reproduced at the end of the relevant Act.  The complete index is here.

4. Statutory Instruments (SI): This section contains individual statutory instruments that have been scanned and uploaded directly from the official Gazettes. Most of the statutory instruments in this section were enacted after 30 June 2012.  If you open one of these pages you will find a hyperlink back to the parent Act.  The complete index is here.

How do I find a piece of legislation on SeyLII?

If you know the name (or part of the name) of the Act or SI you are looking for, you can search for it in three ways:

1. Use the ‘Search this site’ tool in the top center of the SeyLII homepage.
2. Use the ‘Finding Aids’ tool in the left-hand sidebar on the SeyLII homepage.  Click ‘Acts in Force’ or ‘Statutory Instruments in Force’, as applicable, and then click the most recent entry, eg ‘Acts in Force as at 1 December 2014’. This will show you an alphabetical list of all Acts in force as at that date, with hyperlinks to the page for each Act in the SeyLII database.
3. Browse the alphabetical indexes to the four collections described above.

You can also follow hyperlinks from the page for a particular Act or SI to related resources that have been pubished on SeyLII: for example, if you visit the page for the Citizenship Act, you can click on a link to the Citizenship (Amendment) Act, 2013.

If you are looking for legislation on a particular subject or topic, but you don’t know the name of the legislation, try searching by keyword from the SeyLII homepage.  For example, searching for “nuclear” will bring up the Radiation Safety and Security Act, 2014.

How do I know if legislation is up to date?

Each Act published on SeyLII has the words “Consolidated to [DATE]” at the very top of the Act.  This means that the version of the Act you are looking at has been consolidated (updated) to that date.  Any amendments or SIs enacted after that date have not been included.  You will need to find these by following hyperlinks from the Act’s homepage, or by using the ‘Finding Aids’ tool.

If the Act or SI you are looking at is a scanned version of the Official Gazette, then it is correct as at the date it was published in the Gazette, and has not been consolidated (updated) by SeyLII since that date.

Can I rely on legislation I find on SeyLII?

SeyLII is a non-government organisation dedicated to improving public access to essential legal information.   All digital versions of legislation accessible through SeyLII are UNOFFICIAL, and we cannot guarantee their currency or accuracy.  Official versions of Seychelles legislation can only be obtained in hard copy from the Attorney-General’s Chambers, Department of Legal Affairs.
