Referral of a question for determination under article 130 (6) of Constitution by the Supreme Court to the Constitutional Court. In its final determination on the referred question, the Constitutional Court declared that a Supreme COUlt Judge, may, sitting alone, in certain circumstances and under the conditions set out in this judgment, determine the lawfulness of an act of the National Assembly carried out in pursuant to an Act of the National Assembly. However, on the specific facts of this case, a Supreme Court Judge, sitting alone, may not, determine the lawfulness of the act of annulment of a statutory instrument by the National Assembly.
